This agreement applies anytime you make a purchase using LOC PHAT TELECOM LLC (LOC PHAT TELECOM) online payment services. The following online service payment terms are a contract between you and LOC PHAT TELECOM. Please read them carefully. At the end you will be asked to either accept or decline these terms and conditions. You must accept these online service payment terms before you may make payments to LOC PHAT TELECOM using the online service payment terms process. Credit Card/Check Purchase Verification in section 11 applies only to new customers.

1. DEFINITIONS
Unless the context otherwise requires, all terms defined in the website terms of use will have the same meaning in these online service payment terms.

2. AUTHORITY TO ACCEPT TERMS
You warrant that you have the authority and power to validly accept these online service payment terms and any charged service terms and conditions applicable to the charged services which you request through this website. You agree that you are able to, and will, meet your obligations in relation to these online service payment terms and the relevant charged service terms and conditions promptly, efficiently, diligently, professionally and in accordance with any relevant laws. You represent and warrant that you are over 18 and have legal capacity to enter into contract with LOC PHAT TELECOM. If you are using a credit card/check, you represent and warrant that the credit card/check is issued in your name and you will pay all charges incurred through the charged services.

3. ACCESS
To use the online service payment process to pay for charged services or to make payments to LOC PHAT TELECOM, you will be required to first enroll by completing the Service Payment Registration process below. In such cases, if your application is accepted by LOC PHAT TELECOM, you will be issued with a username and password. You will be responsible for all use of the online service payment process through the use of your username and password.

4. PAYMENTS
Payments made by the online service payment process are through a secure website. However you acknowledge and agree that Internet transmissions are never entirely secure or private and that any message or information you provide through the website (including credit card/check information) may be read or intercepted by others. LOC PHAT TELECOM will not have any liability for the interceptions, 'hacking' or other unauthorized access of information through the website by unauthorized third parties.

5.VERIFICATION OF INFORMATION
It is your responsibility to ensure that the transaction, credit card/check information, and all other details you provide in relation to your payments made through the online service payment process are correct and current. LOC PHAT TELECOM will not have any liability for transactions that are incorrect as a result of inaccurate data or information provided by you or that are otherwise caused by factors outside of LOC PHAT TELECOM control.

6. YOUR RESPONSIBILITES FOR THE SERVICE PAYMENT PROCESS
You agree to use the online service payment process only for the purpose of paying LOC PHAT TELECOM for the charged services, or for making payments to LOC PHAT TELECOM which we accept through the online service payment process. You agree not to use the online service payment process for any improper, injurious, offensive or unlawful purposes. You agree not to damage or disrupt the online service payment process. You are responsible for providing to LOC PHAT TELECOM accurate and current information of which you have the authority to furnish in order to access and utilize the charged services.

7. LOC PHAT TELECOM RESPONSIBILITIES FOR THE SERVICE PAYMENT PROCESS
LOC PHAT TELECOM cannot warrant that the online service payment process, and/or your use of the online service payment process, will be faultless, immediate, continuous and virus-free, or that information provided through the online service payment process will be complete, accurate or up-to-date. LOC PHAT TELECOM will endeavor, however, to ensure the online service payment process is functioning properly at all times. LOC PHAT TELECOM reserves the right to alter, suspend or terminate the online service payment process temporarily or permanently at any time.

8. LOC PHAT TELECOM LIABILITY
To the extent permitted by law, except as expressly set out in these online service payment terms, warranties, representations or guarantees (whether express, implied or statutory) in relation to the online service payment process are excluded, including, without limit, any warranty of fitness for any particular purpose; and LOC PHAT TELECOM will not be liable for any damage, loss or expenses, or indirect losses or consequential damages of any kind suffered or incurred by you in connection to the online service payment process. Subject to the provisions of this clause, if for any reason LOC PHAT TELECOM is held to be liable to you in relation to this online service payment process, the total extent of LOC PHAT TELECOM's liability will to the extent permitted by law be limited to: in connection with a charged service, the fees payable by you for that charged service; and in connection with any other use of the online service payment process of up to $100 (one hundred dollars). The exclusions and limits set out in these online service payment terms will also operate for the benefit of LOC PHAT TELECOM partners, licensors and agents which LOC PHAT TELECOM used to provide the online service payment process made available to you.

9. INDEMNITY
You agree to indemnify LOC PHAT TELECOM in respect of any loss, damage, cost or expense (including reasonable enforcement costs, whether incurred on a solicitor and own client basis or otherwise) suffered or incurred by LOC PHAT TELECOM as a result of: a breach by you of any of your obligations under any terms and conditions which you have accepted into in relation to the online service payment process; your intentional misuse of the online service payment process or the website; your negligent acts or omissions; and any claim, suit or action brought against LOC PHAT TELECOM by a third party for any of the matters above.

10. WEBSITE TERMS OF USE & PRIVACY POLICY
The website terms of use govern general use of the LOC PHAT TELECOM websites. Please see LOC PHAT TELECOM’S Terms and Conditions. These online service payment terms form part of the website terms of use. You agree to comply with the website terms of use, any terms and conditions relating to a charged service or any other service provided to you in connection with the online service payment process and these online service payment terms. The Privacy Policy available on the home page of the LOC PHAT TELECOM websites governs the collection, use and disclosure of your personal information by LOC PHAT TELECOM. The Privacy Policy forms a part of these online service payment terms. You agree to comply with the Privacy Policy as well as these online service payment terms.

11. SERVICE PAYMENT REGISTRATION

ONE-TIME CREDIT CARD/CHECK PURCHASE VERIFICATION FOR NEW CUSTOMERS:
We respect your privacy and are committed to protecting your personal information that you provided to us. To protect our customers and prevent fraud, we request copies of certain documents to verify the authenticity and identity of the credit card/check purchaser. This is a one-time verification process. Upon approval, no future documents are required.

(A) Please choose two documents from the list to submit:
1. Photocopy of a current Driver’s license
2. Photocopy of the front & back of credit card/check
3. Photocopy of utilities bill (gas or electric), within 3 months or less
4. Photocopy of current phone bill (home or cellular), within 3 months or less
5. Photocopy of credit card/check or bank statement, within 3 months or less
